Durante las audiencias declararon ambos actores, el terapeuta del adolescente y un funcionario escolar. Maceo también ofreció su testimonio en una sesión privada el 19 de octubre. La defensa de Berry solicitó recuperar el esquema de custodia compartida, pero la jueza rechazó la petición.
La actriz conserva la custodia legal conjunta y tendrá poder de desempate cuando ambos padres no logren acuerdos sobre decisiones relacionadas con su hijo. El tribunal también disolvió una orden temporal de protección que Martínez había obtenido el 1 de octubre, aunque mantuvo vigente el régimen de custodia derivado de esa medida hasta una próxima audiencia.

The former couple separated in 2015 but didn’t finalize their divorce until 2023. Under the settlement, Berry agreed to pay Martinez $8,000 a month in child support, plus 4.3% of her annual income exceeding $2 million, while also covering their son’s education and healthcare expenses. They agreed to share 50/50 custody.
Now, they’re locked in another bitter legal battle over their 13-year-old son, Maceo.
Martinez accused Berry of grabbing their son by the throat during an argument over his VR gaming in September. Berry strongly denied the allegations, saying she had never abused her child and that the confrontation began when Maceo refused to stop playing.
Berry also accused Martinez of being too permissive, leaving her to play the strict “bad mom” while he gets to be the “good dad” who lets their son do as he pleases — a parenting dynamic that will sound painfully familiar to many mothers.
Martinez sought sole custody and a domestic violence restraining order, while Berry fought to restore their original 50/50 arrangement.
On October 29, a judge dismissed Martinez’s request for a long-term restraining order and dissolved the temporary order against Berry. However, she was not granted her request to restore equal parenting time.
For now, Maceo will remain primarily in his father’s care, while Berry is allowed daytime visits but no overnight stays.
The custody arrangement is expected to be reviewed again in November.
